MEET OUR LEGAL EXPERT

Nancy Mayer, J.D.

Nancy Mayer is an attorney at law who runs a solo general practice concentrating on Elder Law, Disability Law, and Immigration Law.  She worked for the USEPA for 30 years and has experience with the American Federation of Government Employees, specializing in the Americans with Disabilities Act applications and federal arbitration. She is also an active member of the Society of Women Engineers and North Carolina Association of Women's Attorneys.

Medicaid and Diabetes

Medicaid is a government run health insurance program for poor and disabled people.  According to the American Diabetes Association 3.5 million people with diabetes use Medicaid for all or some of their medical care. Ongoing and preventive health care is particularly important for people with diabetes to avoid many costly medical complications. Many suggested changes to Medicaid may affect the level of care received by Medicaid recipients.

Class Action Lawsuits

There are several class action lawsuits involving drugs that are used by people with diabetes, which allegedly have some very unwanted side effects (e.g., Avantia), and drugs that allegedly cause diabetes (e.g., Zyprexa).  This article provides some basic information about class action lawsuits to assist in the decision on whether or not to join such a lawsuit.

Social Security Programs

Social Security programs for People with disabilities

Two government programs that provide payments to people with disabilities are the Social Security Security Disability Income (SSDI), (also known as Disability Income Benefits), and Supplemental Security Income (SSI).  Many people do not realize that these are two different programs.  The SSDI application is an insurance claim.  The SSI application is a welfare application. An individual must first meet basic eligibility requirements and then they must be declared disabled according to the Social Security Administration.  The eligibility requirements for each program are different, however, the disability criteria are the same.

Having The Right Attitude

Many people do not understand all of their rights or how to use them.  In my practice I spend a significant amount of time with my clients who have a disability making sure they know their rights and keep the right attitude as we go about getting what they deserve.  Below are some tips for anyone who wants to obtain what the law says is rightfully theirs. Although I use the term attorney in this article, in the workplace many of these activities can also be performed by a Union Steward at little or no cost to the client.
